These Terms of Service ("Terms") govern your access to and use of the PingNPlay mobile application, related services, and any associated content or features (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who We Are

The Service is operated by Eric Ordonneau, an independent developer ("PingNPlay", "we", "us", or "our"). If you have questions about these Terms, you can contact us at pingnplay.app@gmail.com.

2. Eligibility

You may use the Service only if:

• you are legally able to enter into a binding agreement; and
• your use of the Service complies with applicable law.

If you are under the age required to consent to digital services in your country, you may use the Service only with the involvement and permission of a parent or legal guardian.

3. The Service

PingNPlay helps users discover ping pong spots, manage profile information, save favorites, share locations, and submit new locations or related content. We may change, improve, suspend, or discontinue any part of the Service at any time, with or without notice, to the extent permitted by law.

4. Accounts

To access some features, you may need to create an account. You agree to:

• provide accurate and up-to-date information;
• keep your login credentials secure;
• promptly update your information if it changes; and
• notify us if you believe your account has been used without authorization.

You are responsible for activity that occurs through your account unless caused by our own failure to use reasonable security measures.

5. User Content

You may be able to submit content through the Service, including profile details, photos, location submissions, feedback, and other materials ("User Content").

You retain ownership of your User Content. However, by submitting User Content through the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, publish, and use that User Content as needed to:

• operate and provide the Service;
• review and moderate submissions;
• improve features;
• investigate abuse or violations; and
• comply with legal obligations.

You represent that:

• you own or control the necessary rights to your User Content;
• your User Content does not violate any law or third-party rights; and
• your User Content is accurate to the best of your knowledge.

6. Acceptable Use

You agree not to:

• use the Service for unlawful, fraudulent, or misleading purposes;
• submit false, abusive, defamatory, obscene, or infringing content;
• upload malware, harmful code, or content designed to disrupt the Service;
• attempt to gain unauthorized access to systems, accounts, or data;
• scrape, copy, or harvest data from the Service in an unauthorized way;
• interfere with the normal operation or security of the Service; or
• impersonate another person or misrepresent your affiliation with any person or entity.

We may investigate violations and suspend or terminate access where appropriate.

7. Spot Submissions and Community Features

If you submit a new location, photo, or related information, you understand that:

• submissions may be reviewed, edited, declined, or removed;
• availability or publication is not guaranteed;
• we may correct formatting, categorization, or descriptive details; and
• we may remove content that appears inaccurate, unsafe, unlawful, or inconsistent with the purpose of the Service.

PingNPlay does not guarantee that any location information, availability, or user-submitted content is complete, current, or error-free.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal data.

9. Third-Party Services

The Service may rely on or link to third-party services, including authentication, cloud storage, analytics, mapping, email, and crash reporting tools. We are not responsible for third-party services, content, or policies, and your use of those services may be subject to their own terms and privacy notices.

10. Intellectual Property

The Service, including its design, software, branding, text, graphics, and other content provided by us, is owned by or licensed to Eric Ordonneau and is protected by applicable intellectual property laws. Except as expressly allowed in these Terms, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if:

• you violate these Terms;
• your use creates legal, security, or operational risk;
• we are required to do so by law; or
• we discontinue the Service.

Where appropriate, we may take less severe action first, such as warning you, removing content, or limiting certain features.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content, locations, or submissions will be accurate, complete, or reliable. Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law.

13. Limitation of Liability

To the fullest extent permitted by law, Eric Ordonneau will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business interruption arising out of or related to your use of the Service.

To the fullest extent permitted by law, our total liability for claims relating to the Service will not exceed the greater of:

• the amount you paid us, if any, for use of the Service in the 12 months before the claim arose; or
• EUR 100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Eric Ordonneau and its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, and expenses arising out of:

• your User Content;
• your misuse of the Service; or
• your violation of these Terms or applicable law.

15. Governing Law

These Terms are governed by the laws of Spain, excluding its conflict of laws rules, unless mandatory local law requires otherwise. Any dispute relating to these Terms or the Service will be brought before the competent courts of Spain, unless mandatory law provides otherwise.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice through the Service or by other reasonable means. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.
